Preamble

Fyve Services is a limited liability company with a capital of 15,871 euros, registered with the Paris Trade and Companies Register under number 853 795 193, with its registered office located at 53 rue de la Montagne de l’Esperou, 75015 Paris (“Fyve”or“we”).

Fyve places great importance on compliance with personal data protection regulations.

The purpose of this Privacy Policy (“Privacy Policy”) is to inform you—regardless of your status (whether you are an employee of our clients, a prospective client, an expert, a consultant, a candidate, a subcontractor, a partner, or a website user) (“you”)—about how we process your personal data in the context of our relationship.

The Privacy Policy complies with the legal provisions applicable to the protection of personal data, including those set forth in Law No. 78-17 of January 6, 1978, known asthe “Data Protection Act,” and in the General Data Protection Regulation No. 2016/679 (the“GDPR”).

Fyve is the data controller for your data for the purposes described in Section 2 of the Privacy Policy.

Recruiting a candidate

Fyve has a legitimate interest in processing job applications, whether unsolicited or otherwise.
Candidates will be asked for their consent to have their resumes stored in Fyve’s databases.

Your data will be processed for the duration of the application review process and then deleted.
With your consent, we may retain your data in our resume database for an additional two (2) years.

Cookies and other commercial trackers may be stored on the user’s device for a maximum period of thirteen (13) months. After this period, raw traffic data associated with an identifier is either deleted or anonymized.
Information collected through cookies and trackers is retained for a period of twenty-five (25) months. After this period, this data is deleted or anonymized.
Handling Data Subject Requests Legal requirement. Identification information. Data related to the processing of rights requests is retained for as long as necessary to process the request.
It is subsequently archived in an intermediate storage system for the duration of the applicable criminal statute of limitations.

3. Data source

Fyve collects and processes your personal data directly from you. If Fyve were to collect your personal data indirectly, you would be notified at the time of collection.

4. Who receives your data?

Within the scope of their respective responsibilities and for the purposes set forth in Article 2, the categories of recipients who may have access to your data are:

  • Authorized staff from Fyve’s various departments (authorized staff from Human Resources, Sales, Accounting, IT, Marketing, and Customer Service);
  • The service provider responsible for hosting and managing the website;
  • Authorized personnel from our subcontractors;
  • Training organizations (OPCOs);
  • Where applicable, the relevant courts, mediators, certified public accountants, auditors, attorneys, bailiffs, debt collection agencies, and regulatory authorities;
  • Third parties that may place cookies on your devices when you give your consent (for more details, see the "Cookie Management" section).

5. Is my data transferred outside the European Union?

Whenever possible, Fyve gives preference to subcontractors located within the European Union.

However, Fyve may transfer your data outside the European Union. These transfers are carried out in accordance with the provisions of the GDPR, and Fyve implements all necessary safeguards to secure your personal data, including by selecting processors located in countries that ensure an adequate level of protection or by applying the European Commission’s standard contractual clauses, supplemented by additional safeguards where necessary.
